Terms of service
Effective date: 01.19.2024
These Terms of Service (“Terms”) are a binding agreement between you and Vega Partners LLC, doing business as MD•8 (“MD•8”), governing your access to and use of our website, applications, and services (the “Services”). By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
MD•8 is not a medical provider
MD•8 is a technology and administrative services company. MD•8 connects users with independent, licensed medical providers who determine whether treatment is appropriate, and with licensed pharmacies that dispense prescriptions. MD•8 does not practice medicine, does not provide medical advice, and does not control the clinical decisions of any provider.
Eligibility
- You must be at least 18 years old and located in a state where we operate.
- You must provide accurate, complete, and current health and identity information.
- You may not use the Services on behalf of another person without legal authority to do so.
Your account
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly of any unauthorized use.
Prescriptions and compounded medications
A prescription is issued only if a licensed provider determines it is clinically appropriate after reviewing your information. Compounded drug products are not approved or evaluated for safety, effectiveness, or quality by the FDA. Individual results vary. Never share prescription medication with another person.
Payments, subscriptions, and refunds
By purchasing a plan you authorize us or our payment processor to charge your payment method on a recurring basis until you cancel. You may cancel at any time before your next billing date. Because medications are personalized and dispensed by pharmacies, shipped medication is generally non-returnable and non-refundable except where required by law.
Shipping
Orders ship discreetly to the address you provide. Risk of loss passes on delivery to the carrier. Delivery timelines are estimates and may be affected by pharmacy processing, weather, or carrier delays.
Acceptable use
- Do not misrepresent your identity or health information.
- Do not attempt to interfere with, reverse engineer, or disrupt the Services.
- Do not use the Services for any unlawful purpose or to resell medication.
Intellectual property
The Services, including all text, graphics, logos, and software, are owned by MD•8 or its licensors and are protected by intellectual property laws. You receive a limited, revocable, non-transferable license to use the Services for personal, non-commercial purposes.
Disclaimers and limitation of liability
The Services are provided “as is” and “as available,” without warranties of any kind, express or implied. To the maximum extent permitted by law, MD•8 will not be liable for indirect, incidental, special, consequential, or punitive damages, and our total liability for any claim will not exceed the amount you paid to MD•8 in the twelve months before the claim arose.
Dispute resolution
Except where prohibited by law, any dispute arising out of these Terms or the Services will be resolved by binding individual arbitration, and you and MD•8 waive the right to a jury trial and to participate in a class action.
Changes and termination
We may modify these Terms and will update the effective date above. We may suspend or terminate access to the Services at any time if you violate these Terms or if required for safety, legal, or operational reasons.
Emergencies
The Services are not for emergencies. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room.
